Another fundamental element of workplace health and safety management – and also a legal requirement – is RIDDOR; the reporting of injuries, diseases and dangerous occurrences regulations 1995. Also of great importance – the childcare act 2006, it stipulates every child should get the support they need to be healthy, safe, and enjoy and achieve economic wellbeing. As a teacher you also need to have your own professional values – views, beliefs that will underpin your profession. â€Å"A good teacher is more than a lecturer.† (AMEE 2000) You are no longer a dispenser of information or a walking tape recorder but instead you are a facilitator or manager of the students learning. You are there to ensure all learners have access to the same resources, the same support and you don’t differentiate – instead embrace and respect people’s differences and their choices. You are there to guide them, provide information and offer suggestions. But it has to be a 2 way process, by helping them you will also develop your skills because â€Å"teaching is itself a learning process for the teacher† (Joyce, Showers 2002). Everyone is different and you need to be prepared and have contingency plans for all levels of knowledge and skill – you will find bored students make bad students. They don’t just have a variety of levels but also different learning styles, be sure to have a mix of kinaesthetic, visual and audio resources. You can use handouts with the camera instructions on, a video showing how it works, and then let them try themselves. It is your responsibility to ensure all students no matter how diverse are given equal learning opportunities – that means assuming different roles. If someone wants to start a business, that person would have to decide which structure he or she would want to use. To know what kind of structure he or she has to know what kind of business he or she is trying to run and who will run it with him or her. Structures range from sole proprietorships and partnerships to corporations. When companies first start up, they consider sole proprietorships or partnerships, but as they grow into larger companies, they become corporations. When someone first opens a business it may just be him or her, those companies consider sole proprietorships, meaning a business owned by one person. There are several advantages when running a sole proprietorship. First is it is the simplest type of business to start and run and also it is not regulated as much. Also, sole proprietorships pay lower income taxes compared to other business structures. Last, when a company is a sole proprietorship, decision-making rest on the owner’s shoulders but the owner keeps all profits (Films Media Group, 2011). Even though there are some very good advantages owning a sole proprietorship, there are also some disadvantages. The biggest advantage is also the biggest disadvantage, the bills, debts, and major obligations. If the owner does not pay the bills, the company cannot run. Another big disadvantage is the capital the business has. If the owner does not have some other capital invested into the company, the company will not grow. The last disadvantage is running the company when the owner leaves or dies. Because there is no one else with stock, the owner has to let the company go (Parrino, Kidwell, & Bates, 2012). The next business structure is a partnership, which consist of two or more owners that legally run the business together. With a partnership, the owners know what his or her position in the company is and how the profits would be split. There are two different partnerships; a general partnership and a limited partnership. The general partnership has the same advantages as a sole proprietorship, but has one more disadvantage. All owners have unlimited liability regardless of  the percenta ge in the company (Parrino, Kidwell, & Bates, 2012). To avoid the big issue with a general partner, the partner would sign into a limited partnership. In a limited partnership, the company can have general and limited partners. One or more general partner has unlimited liability while limited partners only deal with the obligations he or she provides. To qualify as a limited partner, he or she cannot engage in the managing of the business (Parrino, Kidwell, & Bates, 2012). The last business structure is the biggest and the last to get to. Large companies consider themselves to be corporations. Corporations consider themselves as a â€Å"person,† where the corporation can sue and also be sued, borrow money, and own assets like real estate. An advantage of a corporation is that the stockholders have a limited liability for all of the corporation’s obligations. History of Private Investigators in the US Private Security is a corporate business that provide armed and unarmed security services and expertise to public and private security companies. They provide patrolling, surveillance, and protection services for a fee. These services involve, but not limited to, security guards, watch dogs, security monitors, and parking security. Allan Pinkerton, Francois Vidocq, and Jay J Armes paved the way for modern day private security through their investigative techniques, tools, and services that are still either in used or influenced in todays private security sector. Detective Allen Pinkerton first opened up the Pinkerton National Detective Agency in 1849. The Pinkerton agency patrolled the Wild West, stopped bank robberies, counterfeiters, and any crime clients paid or they seem deemed to stop, researched by Bond (2015). Allen Pinkerton and his agency became respected by many, including President Abraham Lincoln where he saved him from an assassination attempt plot on his way to inauguration as President during The American Civil War between 1861-1862. In addition, Pinkerton also created two techniques still in use by intelligence agencies today called Shadowing and assuming a role. Shadowing involve conducting surveillance of a known target or location and recording everything so that a theme emerges from the analysis; and assuming a role which is undercover work where the detective blends into the environment and infiltrates the criminal enterprise, pretending to be a member to gather insider information to stop and prosecute criminal activiti es, researched by Bond (2015). Childhood and Adulthood in The Catcher in the Rye by J.D. Salinger   Ã‚  Ã‚   Holden Caulfield sees childhood as the ideal state of being. He thinks adulthood is filled with corrupt people. The only way anyone can win in the adult world is if the cards are stacked in his favor. The characters in The Catcher in the Rye play a diverse set of roles in the war between childhood and adulthood.      Ã‚  Ã‚   Children do not think of appearances very highly, but in order to be respected in the adult world you must always look your best. Holden did not care what people thought about him as long as he felt good. He would wear his red hunting cap backward (p. 18). He also would have his hair cut crew cut style, which is thought of as a kids haircut. Ackley is the absolute extreme of not just looking, bad but he also had terrible hygiene. He had mossy yellow teeth from not brushing them and bad acne(p.19). Adults always hide their imperfections to make themselves look good, but many are as Holden calls them, secret slobs (p. 27). Stradlater is a perfect example of this. He always shaves twice but never cleans his razor (p. 27). He will spend forever making sure his hair is perfect and all his clothes look just right. Sunny, the prostitute, bleaches her hair and dresses up nice to fit into the adult world (p.95). Mrs. Antolini, a married women, needs to look good when she goes out in public. The night Holden crashes there for a while, she looks terrible without her make-up and with rollers in her hair (p. 185). All that matters is she looks good by society's standards so she can be accepted into the adult world.      Ã‚  Ã‚   Children live on lasting compassionate memories, while adults go for empty sexual conquests. The Baroque Era is a period that existed in European art in the latter 16th, 17th Century, as well as the first half of the 18th Century. Baroque refers primarily to the free style of architecture that formed a restrained and balanced style of the earlier Renaissance. It was later applied to the same tendencies in music, painting sculpture, and literature. The Baroque style stems from the dramatic, large, ornate. The psychodynamic approach was associated with a man called Sigmund Freud, this man believed that the brain was split into 3 parts, just like an ice-burg. At the tip of the ice burg where everybody can see, is the â€Å"Conscious† part of the brain, this holds thoughts and perceptions. The â€Å"Pre Conscious† level is where memories, feelings and past experiences are locked up in our mind but often let out, this holds memories and easily accessed knowledge. The unconscious level is where everything is under the surface and you would never dare to tell anyone other than yourself, this holds unacceptable sexual desires, irrational fears, violent urges, irrational fears, selfish needs and immoral urges. Freud believed that throughout life all of these levels are shown, and sometimes when we say something that we might never thought we would say, that is our unconscious level showing. Freud also said that the early experiences in life were the ones that made you who you were as an adult. If there is struggle throughout certain stages during your early life then this could result to an individual becoming stuck and could result in difficulties of personality traits which may explain some ones behaviour in later life. It is important to recognise that we may not be able to understand behaviours as the individual may not understand themselves what is causing their certain behaviour, the â€Å"psychodynamic therapy† helps to make a person examine unresolved conflicts and symptoms that arise from past relationships and try to find the need and desire to be angry. The therapy usually lasts around 2 years as the therapy is a goal to change an aspect or someone’s identity or personality to resolve when the person was â€Å"stuck† in their childhood stages of development. The advantages of the psychodynamic approach is that it focuses on the cause of the problem rather then just given medicine and treating the symptoms of the patient, it focuses on the real problem that the patient has. It also builds a trusting relationship between a people, for example if someone had psychodynamic counselling the counsellor would make a trusting relationship with the person first, and this may make the person want to â€Å"open up† and discuss certain problems that they are having, this therefore is another advantage. The disadvantages of the approach is that the treatment for the approach can take many years to â€Å"fix† the problem and sometimes it may not possibly work. Also some people may find it harder to â€Å"open up† then others so again it can be very time consuming and at times difficult to try and solve a problem when you don’t know what the problem is. The humanistic approach looks at human experience from the viewpoint of the individual, it focuses on the belief that we are all capable of making choices. Abraham Maslow came up with â€Å"hierarchy of needs† this is a pyramid that involves things that we need to because our â€Å"self actualisation† which is the best that we can be. It starts with basic needs, then safety and security needs, love and emotion needs and then self esteem needs. We have self esteem which is how valuable we feel, the amount of esteem we provide ourselves with. Self-concept is the way in what we see ourselves, and self actualisation is being the best that we can be and achieving full potential. The humanistic approach would usually use treatments such as counselling but base it on something called â€Å"unconditional positive regard† this is to help an individual develop a more positive sense of self. This way, the person over time sees themselves as worthy. This approach would be good for aggression and addiction as it is helping the person to realise that they are worth something and could potentially help stop aggression and addiction. An advantage of the humanistic approach is that it looks at the person as a whole to try and resolve their problem by looking at them as a whole. The humanistic approach provides the foundations and uses active listening and helps in forming a relationship between 2 people. It in itself can enable self actualisation by using the core values (empathy, warmth, attentiveness, unconditional positive regard and genuineness) but other approaches such as CBT would speed up the process, therefore it in itself helps someone to have self esteem etc. The disadvantage of this approach is that there has not been that much evidence of success. Also, the humanistic approach says that each student has their own â€Å"learning style† and the teacher should use this learning style for each independent person, however these learning styles and their evaluations tend to be very unorganised and unwieldy. The social learning approach believes that our behaviour is taught. According to the social learning theory, role models are very important. For example, if we watch someone that we love behaving in a particular way, we are more likely to feel that we have to act like the person is acting. Although this is just an example of what can change our behaviour, groups of people may also change our behaviour but also culture and society could change our behaviour, for example values, norms, language, customs and practices of groups. Also the role that we are in may change our behaviour because of the people around us. This theory therefore is good as the treatment provides positive role models for people that may have got caught up in bad role models, which is why I have chosen it for aggression and addiction, as if you surround these people with good role models they may believe to start believing them selves and come off their addiction and stop being so angry. The advantages of social learning is that it looks at the behaviour of someone as being â€Å"taught† this includes; shyness, optimism, confidence etc. The social learning approach looks at peoples behaviour in detail and this really helps us to understand why people act in the way that they do, so it is helpful as it explains why and where these behaviours have been learnt from (trace its origin). The disadvantages are that it is quite time consuming and does not always cure certain behaviours or illnesses, it also tries to face certain things to overcome their certain behaviour, for example take a person addicted to alcohol, they would give someone alcohol but mix it with a drug which, when mixed with alcohol would lead to sickness, making the person not want to consume alcohol again – but it can be very stressful for that individual and it is also very dangerous. Also not everyone copies someone else’s behaviour so having a good role model not might make a difference, and a person with anger may get angrier by having a happy, bubbly person around them all of the time. The biological approach says that a child is born with a set of genetic instructions passed down from its parents. Cognitive, physical and other development processes unfold over time. It is nothing to do with the environment that we live in. I have particularly chosen the biological approach for â€Å"addiction† as I believe that a lot of people that have been addicted (mostly to drugs and alcohol) usually need medicine to just help them slowly come off of their addiction as well as having over therapies along side. For example, a person that is taking heroin would take the biological approach and be given â€Å"methadone† this is a drug that slowly is introduced to someone that is addicted to heroin and they slowly come off of the heroin and start to take the methadone on its own. I think the biological approach is very helpful in some cases but along side with other approaches. An advantage of the biological approach is that is makes use of scientific and experimental procedures in its investigations and it also strongly supports the nature-nurture debate. The disadvantages is that it doesn’t look so much at how the environment and socialisation affects behaviour and life factors. It believes that everything is to do with the way our genes are and the environment etc will not affect this – we are who we are when we are born and this maps out how we are going to be for the future.

Groups that do not meet the standards are not entitled to POW status, and their members who commit aggressive acts may be treated as civilians under the Geneva Convention Relative to the Protection of Civilian Persons in Time of War†( Terrorism, the Laws of War, and the Constitution Policy Archive ). These â€Å"unlawful combatants† are not afforded immunity for their ostile acts. [A petitioner must be treated as a prisoner of war until a competent tribunal has decided otherwise, and that a military commission may not proceed with their trial. Although 250 detainees (including three children under the age of 16), 13 have been released from the detention facilities at the U. S. Naval Station in Guantanamo Bay, Cuba, and some detainees are being rewarded for cooperation with better living conditions while the status and treatment of detainees who remain in custody continue to be a source of contention] (â€Å"Enemy Combatants† Journal, Wuerth). Although the President has inherent power under the Commander-in-Chief Clause Article II to take measures he deems appropriate during wartime, he uses The law of war principle. President Bush as well as past presidents having been using this to detain, convict or, â€Å"(We understand Congress grant of authority for the use of necessary and appropriate force to include the authority to detain for the duration of the relevant conflict, and our understanding is based on longstanding law of war principles. ); id. at 548-49 (Souter, J. ) Combat Status Review Tribunals (CSRT), which were established by the Defense Department, were put into place for the sole purpose of hearing the cases of the detainees. However, there are many flaws in having such a system determine the legality of one’s detention. The Supreme Court recognizes that the CSRT process for hearing cases puts many â€Å"constraints upon the detainee’s ability to rebut the factual basis for the Government’s assertion that he is an enemy combatant† (Boumediene v. Bush). Some flaws the court points out is that the CSRT assumes that the detainees are guilty before the trial has even started and it is all up to the detainee to prove that they are in fact, not enemy combatants. This goes against the typical US court proceedings when all suspects are presumed innocent until proven otherwise. The bias shown by the members of the CSRT puts the detainees at a disadvantage. Furthermore, while many of the detainees have a limited knowledge of English, they are not given the specifics as to what crimes they are being charged with because the information may be classified. Additionally, with no textual evidence, the detainees often go into the CSRT board empty handed and without legal representation. Not only do the proceedings of the CSRT seem nfair, it also seems to be designed to intentionally make it difficult for detainees to secure their freedom. In closing, the Founding Fathers placed the Suspension Clause in Article 1, Section 9 in the Constitution. This is important because if the founding fathers specifically intended to apply the Suspension Clause to US citizens only, then they would have placed it in the Bill of Rights which are specifically reserved for the people to protect them against the government. Furthermore, the rest of the clauses in Article 1, Section 9 specifically state what types of activities that the Legislative Branch cannot do. Hence, the Suspension Clause, because of its placement, was intended to be a limitation upon the abuse of power by the Legislative Branch. Lastly, the principle of separation of powers came from the idea that each branch would be able to check one another (Checks and Balances). The Military Commissions Act (MCA) of 2006 was an amendment to the Detainee Treatment Act (DTA) which did not allow the Federal Courts to hear writs of habeas corpus from the detainees at Guantanamo Bay. The US Supreme Court decided that because the DTA was an inadequate substitution for habeas corpus, then the MCA annot strip away Federal courts jurisdiction to hear habeas corpus cases. The Military Commission Act of 2006 effectively stops the Judiciary Branch from doing its job therefore making the act or Bill unconstitutional. . So as I read and watch videos to acquire information I ask myself, Are not constitutionally correct? Detainees, Enemy Combatants, or POW should have the same fair and equal treatment whether it is on our soil or their soil. Presidential power, Congress and the Supreme Court should not rule on emotions, but on the principles that guide us as the â€Å"Greatest and most Powerful Nation in the world.
